Creditor’s defense in bankruptcy proceedings
Our client, an individual person, loaned more than RUB 10,000,000 to a major agricultural complex. The commercial court initiated bankruptcy proceedings against the agricultural complex as the debtor based on another creditor’s application. By decision of the court, bankruptcy proceedings were initiated against the agricultural complex.
The applicant for the bankruptcy proceedings initiated a petition to review the court’s decisions pursuant to which our client was the debtor’s creditor in light of newly discovered evidence. The main goal of this application was to exclude our client from the agricultural complex’s creditors list.
Thanks to our work, the application was denied. However, the applicant did not accept this decision and filed an appeal against the order by judicial authority. We prepared the statement and response to the appeal in the same manner.
As a result, our client was not excluded from the agricultural complex’s creditors list.
